Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Dispersed mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Joseph Kinsey ("we," "us," or "our"). We may update these Terms from time to time, and your continued use of the App constitutes acceptance of any changes.

2. Description of Service

Dispersed is a mobile application that helps users discover dispersed camping spots, campgrounds, and outdoor recreation areas. The App provides:

  • Access to curated public data about campsites and public lands that allow dispersed camping
  • User-generated reviews and photos of camping locations ("Check Ins")
  • Spatial search capabilities for finding camping spots
  • Premium subscription features including "Hidden Gems" exclusive content
  • Offline access to camping data for premium subscribers

3. Eligibility and Age Requirements

You must be at least 13 years old to use this App. If you are under 18, you represent that you have obtained parental or guardian consent to use the App. By using the App, you represent and warrant that you have the right, authority, and capacity to enter into these Terms.

4. User Accounts and Registration

4.1 Account Creation

To access certain features, you must create an account by providing a valid email address. You may optionally provide your first and last name.

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4.3 Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for violation of these Terms or for any other reason we deem appropriate.

5. Subscription Services and Billing

5.1 Premium Subscription

Premium features are available through an auto-renewable subscription at $2.99 per month. Premium features include access to "Hidden Gems" exclusive content and offline data access.

5.2 Billing and Renewal

Subscriptions automatically renew unless cancelled at least 24 hours before the current period ends. You may cancel your subscription through your device's account settings or app store.

5.3 Refunds

Refunds are handled according to your app store's refund policy (Apple App Store or Google Play Store). We do not provide direct refunds.

6. User-Generated Content

6.1 Content Submission

You may submit reviews, photos, descriptions, and other content related to camping locations. By submitting content, you represent that:

  • You own the content or have the right to submit it
  • The content is accurate and not misleading
  • The content does not violate any laws or third-party rights
  • The content is appropriate and related to outdoor recreation

6.2 License Grant

By submitting content through the App, you grant us a perpetual, irrevocable, worldwide, royalty-free, non-exclusive license to use, reproduce, modify, distribute, display, and create derivative works from your submitted content for any purpose, including:

  • App functionality and display
  • Marketing and promotional materials
  • Website content and social media posts
  • Commercial purposes

6.3 Zero Tolerance Policy for Objectionable Content

WE HAVE ZERO TOLERANCE FOR OBJECTIONABLE CONTENT OR ABUSIVE USERS. Any content or behavior that violates our community standards will result in immediate action, including content removal and user account termination.

6.4 Content Standards

All user-generated content must comply with our community standards:

  • Relevant: Content must relate to camping, outdoor recreation, or the specific location
  • Respectful: No harassment, hate speech, or discriminatory language
  • Accurate: Information should be truthful and not misleading
  • Legal: Content must not violate any applicable laws
  • Appropriate: No inappropriate, offensive, or explicit material

Objectionable content includes, but is not limited to:

  • Pornographic, sexually explicit, or obscene material
  • Hate speech, discriminatory language, or content targeting individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
  • Threats, violence, or content promoting harm to self or others
  • Harassment, bullying, intimidation, or abusive behavior
  • Illegal activities or content promoting illegal activities
  • Spam, misleading information, or fraudulent content
  • Content that violates others' privacy or intellectual property rights

6.5 Reporting Objectionable Content

If you encounter content that violates these Terms or our community standards, you can flag it for review using the in-app reporting mechanism available on all user-generated content. To flag content:

  1. Tap the options menu on any review, photo, or user-generated content
  2. Select "Flag Content"
  3. Choose the reason for flagging
  4. Submit your report

We commit to reviewing and responding to all content reports within 24 hours. Reports are treated confidentially, and we will take appropriate action, which may include:

  • Immediate removal of the objectionable content
  • Suspension or permanent termination of the offending user's account
  • Reporting illegal content to appropriate authorities when required by law

6.6 Blocking Abusive Users

You can block any user whose behavior you find objectionable or abusive. To block a user:

  1. Tap the options menu on any content posted by the user
  2. Select "Block User"
  3. Confirm the action

Once blocked, you will no longer see content from that user, and they will not be able to interact with your content or view your profile information.

6.7 Content Moderation and Enforcement

We actively moderate user-generated content to maintain a safe and respectful community. We reserve the right to:

  • Review, edit, or remove any user-generated content at our sole discretion
  • Suspend or terminate accounts that violate these Terms
  • Remove content without prior notice if it violates our standards
  • Implement automated and manual moderation systems

We will eject users who violate our community standards and will inform law enforcement when required to do so. We take our responsibility to moderate user content seriously and will act swiftly to remove objectionable content and terminate accounts that engage in prohibited behavior.

7. Prohibited Uses and Conduct

You agree not to:

7.1 Data Restrictions

  • Download, scrape, extract, or copy our campsite database or any portion thereof
  • Use automated tools, bots, or scripts to collect information from the App
  • Reverse engineer the App to access underlying data
  • Create derivative databases from our content
  • Use our data for commercial purposes without explicit written permission

7.2 Misuse of Service

  • Use the App for any unlawful purpose or in violation of any local, state, national, or international law
  • Transmit any harmful, threatening, abusive, or defamatory content
  • Impersonate any person or entity or misrepresent your affiliation
  • Interfere with or disrupt the App's functionality or servers
  • Attempt to gain unauthorized access to any portion of the App

7.3 Spam and Abuse

  • Submit false, misleading, or duplicate reviews or information
  • Engage in spam or mass posting of content
  • Submit content unrelated to the specific camping location
  • Create multiple accounts to circumvent restrictions

8. Intellectual Property Rights

8.1 Our Content

All content in the App, including campsite data, maps, text, graphics, logos, and software, is our property or used under license. This content is protected by copyright, trademark, and other intellectual property laws.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.

8.3 Proprietary Data

All campsite data, curated information, and maps are our proprietary assets. You may only access this information through the App interface for personal use.

9. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to the collection and use of information as described in our Privacy Policy. 10. Location Services and Safety

10.1 Location Data

The App uses GPS and location services to provide camping information relevant to your location. You may disable location services through your device settings, though this may limit App functionality.

10.2 Safety Disclaimer

IMPORTANT SAFETY NOTICE: Camping and outdoor recreation involve inherent risks. You are solely responsible for your safety and the safety of others when using information from the App. We strongly recommend:

  • Verifying that camping is permitted with local authorities and land management agencies
  • Informing others of your travel plans
  • Carrying appropriate safety equipment
  • Checking weather and road conditions
  • Following Leave No Trace principles
  • Complying with all applicable laws and regulations

10.3 No Liability for Outdoor Activities

We are not responsible for any injuries, damages, or losses that occur during your outdoor activities, regardless of whether you used information from our App.

11. Third-Party Services

The App may integrate with third-party services including:

  • Mapbox for mapping services
  • Google Analytics and Mixpanel for usage analytics
  • AWS for data storage and processing
  • Payment processors for subscription billing

Your use of these services is subject to their respective terms of service and privacy policies.

12. Disclaimers and Limitations of Liability

12.1 Service Availability

We strive to maintain App availability but do not guarantee uninterrupted service. The App may be unavailable due to maintenance, updates, or technical issues.

12.2 Information Accuracy

While we work to provide accurate information, we do not warrant that campsite data, user reviews, or other content is accurate, complete, or current. You should verify information independently before making travel decisions.

12.3 Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, OR OTHER INTANGIBLE LOSSES.

13. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including attorney fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you submit through the App

14. Force Majeure

We shall not be liable for any failure or delay in performance due to events beyond our reasonable control, including natural disasters, government actions, or technical failures.

15. Governing Law and Dispute Resolution

15.1 Governing Law

These Terms are governed by the laws of Arkansas, without regard to conflict of law principles.

15.2 Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

15.3 Class Action Waiver

You agree to resolve disputes individually and waive any right to participate in class-action lawsuits or class-wide arbitration.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding your use of the App.

By using the Dispersed app, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
